1. The Service

TargetGum is an online marketing platform: planning, AI suggestions, design tools, publishing to connected channels, approvals and reports. Features depend on your plan and on the services you connect. We keep improving the Service and may add, change or retire features; we will give reasonable notice before removing anything important from a paid plan.

2. Your account

• You must be at least 18 and give accurate information.
• Keep your password private. You are responsible for activity in your account and for the people you invite to your workspace.
• Tell us straight away at info@tapashub.com if you think your account has been misused.

3. Plans, subscriptions and payment

• The Free plan costs nothing. Paid plans are subscriptions billed in advance, monthly or yearly, in Indian rupees, at the price shown on Pricing when you subscribe. The price shown includes GST where applicable.
• Payments are processed by Razorpay. By subscribing, you authorise recurring charges to your chosen payment method until you cancel.
• Your subscription renews automatically at the end of each period unless you cancel before then.
• If a renewal payment fails, we may retry it; if it still fails, your workspace moves to the Free plan. Your data is kept.
• Upgrades take effect straight away. Downgrades and billing changes take effect at the end of the period you have paid for.
• We may change plan prices. A new price applies only from your next renewal after we have told you about it, and you can cancel before it applies.
• Plan limits (such as AI actions or reports) reset each billing period. Unused allowances do not carry over.

4. Your content

You own what you put into TargetGum and what you create with it, including AI-assisted designs and copy, subject to the rights of others in material you upload. You give us permission to store, process and display your content only as needed to provide the Service to you. You are responsible for having the rights to what you upload and publish, and for checking that your ads and posts are accurate and lawful.

5. AI-generated content

AI suggestions, copy, images and analysis can contain mistakes. They are suggestions for you to review, not professional, legal or financial advice. Nothing is published or spent on your behalf without your approval, and you remain responsible for what you approve.

6. Connected services

When you connect a third-party service (such as social networks, Google, Meta or Canva), your use of it is also governed by that service's terms. We are not responsible for those services, their availability, or changes they make. If a connected service is unavailable, TargetGum tells you so instead of showing invented data.

7. Acceptable use

You agree not to use TargetGum to:

• break any law, or publish content that is misleading, defamatory, hateful, obscene or infringes someone else's rights;
• send spam or run deceptive advertising;
• try to access other users' data, break or test the security of the Service without permission, or overload it;
• copy, resell or reverse-engineer the Service, or use it to build a competing product.

We may suspend or close an account that breaks these rules, telling you why where we can.

8. Our intellectual property

The Service, including its software, design, templates, the TargetGum name and Gummy, belongs to us or our licensors. Your subscription gives you a personal, non-transferable right to use it while your account is active. Templates and stock assets may be used in designs you make with TargetGum.

9. Availability

We work to keep TargetGum running reliably, but it is provided "as is" and may sometimes be unavailable for maintenance or reasons outside our control. We do not promise any particular marketing result.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue, data or business opportunities. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

11. Ending your use

You can stop using TargetGum and cancel your subscription at any time from Billing in the app. You can ask us to delete your account by writing to info@tapashub.com. When an account is closed, we handle your data as described in our Privacy policy.

12. Changes to these terms

We may update these terms. For important changes we will tell account owners by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in India. Before going to court, please write to us so we can try to resolve it.
